Governor & Florida Senate substantially increases environmental fines many focused on wastewater infractions

TALLAHASSEE, Florida – Governor Ron DeSantis’, working with Florida Senate increased fines on environmental discharges or exceedances found support from the Senate Environment and Natural Resources Committee resulting in large hikes in the amounts and duration of penalties for violating Florida environmental guidelines and laws. While this move may move some violators to act and may appear reasonable to many people, Bill Sponsor Joe Gruters, R-Sarasota, said “Floridians deserve the strongest reasonable protections” and that many penalties the Department of Environmental Protection can impose (50% increase in penalties), these restrictions may prove impossible or at least hard to live by as punitive costs for small businesses and wastewater treatment facilities. Florida Department of Environmental Protection Operation and Maintenance requirements of a Potable Water Treatment Plant

TALLAHASSEE, Fla. – Gov. Ron DeSantis’ request to boost fines on environmental lawbreakers drew support Monday in its first legislative appearance. With little comment, the Senate Environment and Natural Resources Committee unanimously supported the proposal (SB 1450), which would make numerous changes in the amounts and duration of penalties for violating Florida environmental laws. Bill Sponsor Joe Gruters, R-Sarasota, said “Floridians deserve the strongest reasonable protections” and that many penalties the Department of Environmental Protection can impose haven’t been increased since 2001. “Every three hours of every day of the week, seven days a week, of 365 days a year, there is a spill somewhere in Florida,” Gruters said. “We’re way past the time of not addressing this issue.” Most of the changes would increase penalties by 50 percent. Revised Total Coliform Rule

Rule Summary The Environmental Protection Agency (EPA) published the Revised Total Coliform Rule (RTCR) in the Federal Register (FR) on February 13, 2013 (78 FR 10269) and minor corrections on February 26, 2014 (79 FR 10665). The RTCR is the revision to the 1989 Total Coliform Rule (TCR) and is intended to improve public health protection. All public water systems (PWSs), except aircraft PWSs subject to the Aircraft Drinking Water Rule (ADWR) (40 CFR 141 Subpart X), must comply with the RTCR starting April 1, 2016, or an earlier state effective date. Until then, PWSs must continue complying with the 1989 TCR.   Total coliforms are a group of related bacteria that are (with few exceptions) not harmful to humans. A variety of bacteria, parasites, and viruses, known as pathogens, can potentially cause health problems if humans ingest them.
